Terms of service

1. Acceptance of these terms

These terms form the agreement between MLJ, SASU, the company that publishes ChalkHandoff, and the person or organization that subscribes to it. You accept them when you create an account, when you send a request through this site and then start a subscription, or when your school signs an order form that refers to this page. If you are agreeing on behalf of a school, a district or a charter network, you confirm that you have authority to bind that organization.

2. What the service does

ChalkHandoff is a web based subscription service for K12 classroom teachers and school office staff in the United States. It stores reusable substitute plan templates, seating charts, bell schedules, specials rotations, duty assignments, dismissal groups and emergency procedures for a classroom, keeps them current from roster and calendar data you provide, and assembles them into a handoff pack that can be sent to a guest teacher and to the front office on an absence day. It also collects end of day notes from the substitute and keeps a coverage log per teacher and per building.

ChalkHandoff does not find, book, schedule or pay substitute teachers. It does not replace an absence management system, a payroll system or a student information system. It is a planning and handoff tool that sits alongside them.

3. Accounts and eligibility

You must be at least 18 years old and employed by, contracted to, or volunteering for a school or district to hold an account. Accounts are personal: credentials are not shared between staff members, and each teacher on a Grade Team or School plan holds their own login. You are responsible for the accuracy of the information in your account and for everything done through it. Tell us promptly at the contact address below if you believe an account has been used without permission, and we will suspend it while we look.

4. Acceptable use

Use ChalkHandoff for running your classroom and your building. Do not use it to store information you have no right to hold, to send handoff packs to people who have no professional reason to receive them, to attempt to access another building's records, to probe or overload the service, to resell access, or to copy the product for a competing service. We may suspend an account that puts student information or the service itself at risk, and where we can we will contact the account holder before doing so.

You are responsible for what you type into free text fields. Sensitive details about a student belong in the fields designed for them, behind the need to know flag, and not in a note that will be visible to every substitute who opens a pack.

5. Subscriptions, prices and billing

Three plans are offered, each billed monthly in United States dollars: Single Teacher at $9 per month for one classroom, Grade Team at $39 per month for up to eight teachers, and School at $149 per month for one building including the front office dashboard. Prices exclude any sales or use tax that a jurisdiction applies. The plan you choose renews automatically each month on the anniversary of the day you started, and the charge is taken on that date.

Schools may pay by purchase order instead of card, in which case an invoice is issued for the agreed period and is payable within thirty days of issue. We provide a signed W-9 and any vendor registration paperwork the district requires. If a price changes, existing subscribers are told at least sixty days in advance by email, and the new price applies from the following renewal date.

6. Cancellation and refunds

You can cancel from the billing screen at any time, without contacting anyone. Cancellation takes effect at the end of the monthly period you have already paid for, and the account then becomes read only for sixty days so that you can export your folders, seating charts and coverage logs. We do not prorate a partial month. If ChalkHandoff has failed to deliver a handoff pack on a day you needed it and the fault is ours, write to us and we will refund that month.

7. Your data and who owns it

Everything you put into ChalkHandoff stays yours, or your district's. That includes plans, seating charts, schedules, attachments, substitute notes and coverage logs. We process it to run the service you subscribed to, and for no other purpose. We do not use customer content to advertise, and we do not sell it. Where a school or district signs a student data privacy agreement with us, that agreement governs student records and takes precedence over this section to the extent of any conflict.

Export is available in PDF and CSV formats for as long as your account is active and during the read only period after cancellation. On written request we delete a building's records within thirty days, apart from what we must keep for accounting and tax purposes.

8. Availability of the service

We target 99.9 percent monthly availability outside announced maintenance windows, and we schedule maintenance for weekends or after 8 p.m. Central Time because absence mornings are the busiest hours of the product. Handoff packs are cached so that a pack already sent stays readable on a substitute's phone even if the service is briefly unreachable. We do not guarantee uninterrupted operation, and we are not responsible for failures in your internet connection, your device, your student information system or your email provider.

9. Warranty disclaimer

ChalkHandoff is provided as it stands. Beyond the commitments written in these terms, we make no warranty that the service will meet every requirement of a particular classroom, building or district, that it will be free of defects, or that any specific result described on this website will be repeated in your building. Nothing in this section limits any warranty that cannot be excluded under the law that applies to you.

10. Limitation of liability

To the extent permitted by law, our total liability arising from or connected to the service in any twelve month period is limited to the amount you paid for the service during that period. We are not liable for indirect or consequential loss, including loss of instructional time, staffing costs, reputational harm, or the consequences of a decision taken by school staff. Schools remain responsible for supervision, safeguarding, emergency procedures and the accuracy of the instructions they give to a substitute. Nothing here limits liability for death, personal injury, fraud or any liability that cannot be limited by law.

11. Indemnity

You agree to hold MLJ, SASU harmless from third party claims that arise because you used the service outside these terms, uploaded content you had no right to hold, or shared handoff packs with people who had no professional reason to receive them. We will tell you promptly about any such claim and give you a reasonable opportunity to take part in the defense.

12. Changes to these terms

We may update these terms to reflect a change in the product, in our operations or in the law. Material changes are announced by email at least thirty days before they take effect, and the date at the top of this page is updated. If you do not accept a change, you may cancel before it takes effect and we will refund any unused prepaid period.

13. Governing law and jurisdiction

These terms are governed by French law. If a dispute cannot be settled amicably within sixty days of a written notice, it is submitted to the competent courts of Paris, France. Where a United States public body cannot lawfully accept that jurisdiction, the parties will agree in the order form on a mutually acceptable forum before the subscription starts.
